SMS/TEXT MESSAGING POLICY

The Black Business Coalition (“BBC,” “we,” “our,” or “us”) may communicate with members, applicants, business owners, affiliates, referral partners, contractors, event participants, directory listing participants, customers, and website users through text messages (“SMS”), multimedia messages (“MMS”), and other mobile messaging services.
This SMS/Text Messaging Policy explains how the Black Business Coalition collects consent, sends text messages, manages subscriber preferences, and protects user rights.
By providing your mobile phone number and opting into BBC text messaging programs, you agree to the terms of this Policy.
1. PURPOSE OF TEXT MESSAGING
The Black Business Coalition may use text messaging to provide:
- Membership updates
- Program announcements
- Event reminders
- Event confirmations
- Appointment reminders
- Business opportunity notifications
- Referral program updates
- Affiliate program communications
- Directory listing notifications
- Educational content
- Training updates
- Promotional offers

2. CONSENT TO RECEIVE TEXT MESSAGES

- Texting a keyword to a BBC number,

The Black Business Coalition does not charge for receiving text messages unless specifically disclosed.
Your mobile carrier’s standard messaging and data rates may apply.
Participants are responsible for any fees charged by their mobile service provider.
5. OPTING OUT
You may opt out of receiving text messages at any time.
To stop receiving messages, reply:
STOP
Upon receiving a valid STOP request, the BBC will make reasonable efforts to remove your number from applicable SMS marketing lists.
You may receive a final confirmation message confirming your opt-out request.
Opting out of marketing messages does not necessarily prevent the BBC from sending:
- Transactional messages
- Legal notices
- Security notifications
- Administrative communications
- Membership-related communications where permitted by law

7. ACCURATE CONTACT INFORMATION
You agree to provide and maintain accurate contact information.
You represent that:
- You are the authorized user of the mobile phone number provided.
- You have authority to consent to receiving messages at that number.
- You will notify the BBC if your phone number changes.
The BBC is not responsible for messages sent to reassigned numbers when users fail to update their information.
8. THIRD-PARTY MESSAGING PROVIDERS
The BBC may utilize third-party messaging platforms and service providers to deliver SMS and MMS communications.
These providers may process:
- Phone numbers
- Message content
- Delivery information
- Opt-in records
- Opt-out records
solely for the purpose of administering messaging services.
The BBC is not responsible for outages, delays, errors, or failures caused by third-party messaging providers or mobile carriers.
9. PRIVACY OF TEXT MESSAGING INFORMATION
Information collected through text messaging programs may include:
- Phone numbers

- Delivery status
- Opt-in records
- Opt-out records
- Communication preferences

10. NO GUARANTEE OF DELIVERY
The BBC does not guarantee:

The BBC shall not be liable for delayed, failed, or undelivered messages.

The BBC does not guarantee:

12. PROHIBITED USE
Subscribers agree not to:
- Use automated systems to abuse SMS programs.
- Submit fraudulent information.
- Interfere with messaging systems.
- Misrepresent identity.
- Use messaging programs for unlawful purposes.
The BBC reserves the right to suspend participation for misuse.
13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BLACK BUSINESS COALITION SHALL NOT BE LIABLE FOR:
- Delayed messages
- Undelivered messages
- Carrier failures
- Service interruptions
- Lost profits
- Lost opportunities
- Indirect damages
- Consequential damages
- Incidental damages
arising from participation in SMS programs.
14. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless the Black Business Coalition and its officers, directors, employees, volunteers, contractors, affiliates, sponsors, and partners from claims arising from:
- Your use of SMS services
- Violations of this Policy
- Misuse of messaging programs
- Incorrect information provided by you
15. CHANGES TO THIS POLICY
The BBC reserves the right to modify this SMS/Text Messaging Policy at any time.
Updated versions become effective upon posting to the BBC website.
Continued participation after modifications constitutes acceptance of the revised Policy.
16. GOVERNING LAW
This Policy shall be governed by the laws of the Commonwealth of Virginia without regard to conflict of law principles.
